Loudoun Water Board Approves Community System Rate Increase
Also Approves Monthly Billing for Community System Customers

Ashburn, Virginia – February 10, 2012: During its February board meeting held Thursday, February 9, 2012, Loudoun Water’s Board of Directors voted 5-2-2 to approve a rate increase for developer-initiated community systems and the implementation of a three-tier water rate system consistent with the system for Loudoun Water’s Central System customers. Voting for the proposal were Loudoun Water Board Chairman Fred Jennings and Board Members Johnny Rocca, Mark Koblos, Pravin Gandhi and Ralph Watson. Voting against the proposal were recently appointed Board Members Hobie Mitchel and John Whitmore.
Rate studies conducted for Loudoun Water showed the cost for operating the community systems results in almost a $100,000 annual deficit. The deficit is tripled if renewal, replacement and capital funds are NOT fully recovered. “No one wants to see their rates go up,” said Chairman Jennings. “On the other hand, it is the number one responsibility of [the Loudoun Water] board to set rates. We are under a fiduciary responsibility to recover costs and not to operate at a deficit.”
The following rates and structure will be put in place for all usage on or after February 10, 2012, for Community System residents in Lenah Run, Elysian Heights, Raspberry Falls, Selma Estates, Beacon Hill, Rokeby and Courtland. New metered community systems that begin service will also adhere to this schedule. Community System customers will also begin to be billed on a monthly basis instead of the current quarterly process.

The approved path forward differed from an initial proposal before the Board in January, which included a three-stage rate increase for years 2012, 2013 and 2014. Comments and questions received during the public comment period requested that the board reconsider its proposal due to its financial impact and a perceived lack of transparency by Loudoun Water. While all legal requirements for public notice were met, five public workshops were held, and a detailed letter was sent to every Community System customer, the board determined that, as a courtesy to the customers, a summary document detailing the proposal should be made available to the public prior to the board’s vote.
The summary document was created in January by Municipal & Financial Services Group and reflected their recommendation for rates. The document was posted online on www.loudounwater.org, sent to the media, and emailed directly to all Community Systems residents and homeowners associations, which gave their email addresses to Loudoun Water.

In a 6-2-1 vote, the board then chose to defer a vote on the 2012 rate structure and rate increase to its February meeting to be held February 9, 2012, at 3 p.m. at Loudoun Water’s Administration Building, 44865 Loudoun Water Way, in Ashburn.

During its January meeting on Thursday the 12th, Loudoun Water’s Board of Directors considered a proposal for a tiered rate structure and a three-year rate increase. Beginning in September, public high schools across Loudoun County will have a new addition to the Health and Driver Education curriculum: blood donation and collection information. Currently, less than 38 percent of the general population is eligible to donate blood, but the donation rate among 16- to 21-year-olds is at least 75 percent.

After years of complaints about water quality in a community near Leesburg, the Loudoun Water board of directors will vote Thursday on whether to fund a study examining the possibility of extending a central water pipeline from Leesburg to Raspberry Falls, a subdivision north of town and west of Route 15.

Because Raspberry Falls is part of a rural zoning area, the extension of a central pipeline from Leesburg would require that the supervisors first vote to rezone the community in the county's general plan.
Greg Branic, a member of the Raspberry Falls homeowners association, said that resistance to extending the pipeline is more about the politics of development in a rapidly growing county than addressing a legitimate health problem.
"This is a public safety hazard," Branic said. "It's frustrating for the residents, because it's been really poorly managed and mishandled."

Loudoun County will hold a public hearing on September 29th addressing the proposed amendments to the Limestone Overlay District Zoning Ordinance. All property owners should have received the announcement letter. If not, a copy is attached for reference.
Dear Raspberry Falls Residents, Good news. We have received the final results from samples taken on Tuesday, and again, there were no traces of coliform bacteria. We informed the Virginia Department of Health (VDH) of the results, and they have advised Loudoun Water that we can lift the Precautionary Boil Water Notice.
As noted previously, in consultation with the VDH, we issued the boil water notice as a precaution. The distribution system has safeguards to minimize chances of water contamination when pressure drops, and we maintain disinfectant in the system, so the tests were to ensure that your water maintained public health standards.

On Sunday evening, June 13, 2010, the Raspberry Falls water treatment plant experienced a short disruption in service that prevented pumping water into the system for approximately two hours. This caused several customers to lose water pressure at their residences. Because the distribution system has safeguards to minimize chances of water contamination when pressure drops, and we have maintained disinfectant in the system, we believe that your water continues to meet public health standards. However, through an abundance of caution and in consultation with the Virginia Department of Health, Loudoun Water is issuing a Precautionary Boil Water Notice. Operations staff has collected water samples and additional samples will be taken on both Monday and Tuesday. Loudoun Water will remove the Precautionary Boil Water Notice on Wednesday pending sample results.
Loudoun Water will provide an update Tuesday once the first bacteriological sampling results are received.

Pool season is right around the corner, and your Association is ready to ease you into the water! The pool is scheduled to open May 29th.
Prior to the beginning of the 2010 pool season, every owner must complete and return a pool application (enclosed) whether one has been previously submitted or not. Applications must be received by Armstrong Management Services, Inc. prior to May 15, 2010 in order to ensure your application is processed in time for you to use the pool on opening day. Applications can be mailed, faxed, or hand delivered to Armstrong Management Services, Inc.
Pool access will only be permitted to those owners who are in good standing with the Association. If you are a tenant and your landlord has outstanding assessments or uncorrected violations, the Association will not allow you to use the pool.
If you are renting your property, you may convey your right to use the pool to your tenant by completing the appropriate section of the pool application.

On Wednesday, February 17th, the Loudoun County Board of Supervisors voted to impose the Limestone Overlay District which alters the way property owners use their land on over 14,000 areas north and south of Leesburg. The LOD regulations apply to all land development applications and those property owners who disturb land within the district.
The regulations would establish setbacks around the karst and sensitive environmental features, restrict uses within such setbacks, require a geophysical study of a site prior to undertaking land development or land disturbance, establish standards for such geophysical studies, require communal well and sewage disposal systems for developments of fifteen or more lots, increase the hydrogeologic study requirements for communal systems, prohibit certain uses in the district, including irrigation systems and establish a requirement to provide notice in all deeds, site plans, and record subdivisions for properties subject to the LOD.

Loudoun County Dulles District Supervisor Stevens Miller request to VDOT to clarify road clearing procedures (where and when) received this explanation:
1. What is VDOT's policy governing which roads are plowed and when?
Crews first clear interstates, primary roads and routes that connect localities, fire stations, employment hubs, military posts, schools, hospitals and other important public facilities. They will then treat secondary roads and subdivision streets if multi-day storms hit Virginia, but crews will focus efforts on roads carrying the most traffic.
2. Why are some side streets and other secondary roads plowed while others nearby are not?
Pre-assigned maps are provided to VDOT’s contractors assigned to specific subdivision streets. Only when there is more than two inches of snow and/or there is ice accumulation exceeding 1/10 of an inch does VDOT assign contractors to subdivisions. However, thoroughfares within subdivision streets, streets next to emergency facilities, hospitals, fire stations, etc. are addressed first.
Many subdivisions have more than one plow assigned to them to clear the streets. If one plow does not get to your street, it probably means another one has been assigned to your part of the neighborhood and will be along soon. Please note that crews clear a path through subdivisions so that vehicles can reach the main roads - they are not cleared curb to curb. 3. How can a resident receive a prediction from VDOT as to when a certain street will be plowed?
As much as VDOT would like to get to all subdivision streets right away, it is not always possible. Depending on the amount of snow and/or type of weather event, it could take anywhere from 48 hours or more to treat/plow subdivision streets. Interstates and other high-volume commuter routes must be the top priority.
4. Why is it that some streets marked with numbers, or otherwise known to be under VDOT control, never get plowed at all?
VDOT recognizes that it does not have a perfect snow removal process, but it is continuously working hard to improve upon it. There are times where some streets are missed by VDOT contractors. Please have patience but if you feel your street has been ignored, contact VDOT at NOVAInfo@VDOT.Virginia.gov or (703) 383-VDOT.

security practices. The holiday season is typically one of the highest crime

as they carry them out of stores, from their parked vehicles, and from their
homes. We encourage you to take the following security measures during the
holiday season.
George Mason University announced a major land gift of 37 acres in Loudoun County, Va., from Van Metre Companies. The property is located in Ashburn, near exit 6 of the Dulles Greenway. It is within one mile of a future Dulles Corridor Metrorail station.
“We are very excited and appreciative of the great generosity of the Van Metre Companies,” says Mason President Alan Merten.
“As we assess the university’s future and determine how best we can
continue meeting the educational needs of our region, this significant gift provides us with strong options to make many of our programs more accessible to many more people.”
Mason is part of the Loudoun Planning Project, a partnership with Northern Virginia Community College, Loudoun County Public Schools, the Town of Leesburg and the Loudoun County government. The group is exploring the possibility of using the land to establish a Loudoun County campus for George Mason University.
At this juncture, the TLUC has approved modifications to the provisions related to the disclosure notice, garden sizes and structures size exemptions. The TLUC will meet on December 16th to discuss further modifications to the proposal which may be considered

Effective immediately, there will not be a separate mailing to announce official HOA meetings. Instead, a banner will be placed at the entrance to Raspberry Falls encouraging residents to check the Website. Pool season is right around the corner, and your Association is ready to ease you into the water! Prior to the beginning of the 2009 pool season, every owner must complete and return a pool application (2009 Pool Pass Application.pdf) whether one has been previously submitted or not. Applications must be received by Armstrong Management Services, Inc. prior to May 11, 2009 in order to ensure your application is processed in time for you to use the pool on opening day. Applications can be mailed, faxed, or hand delivered to Armstrong Management Services, Inc.
Pool access will only be permitted to those owners who are in good standing with the Association. If you are a tenant and your landlord has outstanding assessments or uncorrected violations, the Association will not allow you to use the pool. However, before the suspension of any privileges, a hearing will be held with the Board of Directors.
If you are renting your property, you may convey your right to use the pool to your tenant by completing the appropriate section of the pool application.

In case you are wondering about the status at our neighboring Selma development:
The economic downturn has some developers feeling the pain. Selma Estates, LLC (An Edgemoore limited liability company) filed for Chapter 11 in November of last year. The company has stopped work on the Historic Selma property. Winchester Homes continues its new construction work and has about six lots left under an agreement with Edgemoore.
A Winchester VP said:
while the work stoppage has required Winchester to answer some challenging questions from visitors at the model home, the sales activity at Selma by his company continues.

The HOA recently sent notices to several homeowners stating black algae stains are a maintenance violation that requires mitigation (cleaning). These black stains typically occur on north facing roofs (receives little sunshine and can remain damp for long periods) and are caused by an airborne algae (type of mold) that is endemic to the east coast from Florida to New England. Once a roof is affected, the spores can literally spread from home to home. There are several remedies not the least of which is roof replacement (ouch). There are also several products and countless businesses that claim the offending spores and resulting stains can be removed. Here are the remedies:

On Thursday, June 19th, Con-Serv Industries delivered new 48 gallon recycling containers to all residents in Raspberry Falls. We distributed notification asking that residents leave out their smaller containers that morning for pickup. Several residents did not leave their small containers out so we are asking that if you still have the smaller bins, please place those recycling bins curbside this Thursday, June 26th by 6:00a.m. A truck will be by to pick up the old containers. Please use these new containers for the single-stream recycling program.
On Thursday, June 19th, CSI will be delivering a single 48 gallon container for all recycle material. Please have your smaller containers curbside by 6:00 am and leave the containers out for pick up by CSI. The larger containers will be delivered the same day.
There are many of us (maybe all of us) that only received one recycle bin from our new contractor (CSI). After waiting patiently for an answer from the HOA, I called CSI to get the straight scoop. Here it is:
They didn't have enough on hand to provide two to each homeowner. More bins are on order and will be delivered as soon as they are received by CSI. In the meantime, I will improvise (save those boxes from COSTCO!).
The Loudoun County Board of Supervisors voted 7 to 2 to deny permits to build several cell towers in western Loudoun. Here's an excerpt from Sally Kurtz, Catoctin supervisor:
The towers would have detracted from western Loudoun's historical charm and natural beauty. Imagine a gigantic fake pine rising 40 feet above the rest of the trees. ... We sell scenery. Our rural tourism business is booming, and that is because of the way the area looks.
Supervisors Waters and York (board Chairman) voted to approve the applications on grounds that many residents in western Loudoun are unable to access broadband internet that the new towers could provide. They also cited a safety concern because of spotty cell coverage in some areas.
So, no new cell towers in the vicinity of Raspberry ... at least not for now.
The homeowners elected Kathy Haberman to the HOA Board of Directors at the annual meeting tonight. Kathy is a 14 year Leesburg resident and a Raspberry resident since 2004. She currently is serving on the Landscape and Budget committee with Scott Lutz, Matt Elliott and Greg Branic. She is looking forward to serving the community as a Board member and preserving the Raspberry character and quality of life we all enjoy. Kathy is now the second homeowner on the Board as we prepare for the long anticipated HOA turnover to the residents from Van Metre.
Con-Serv Industries (CSI) becomes our new trash pickup contractor effective March 1st . The last pickup by Potomac Disposal Service (PDS) will be February 28th. Pickup days will remain the same; Monday and Thursday. Containers need to be curbside by 7:00 am on collection days. PDS will pickup their containers and recycling bins on February 28th and 29th. CSI will begin delivering containers beginning February 27th. Additional details follow:

Letters were sent to all homeowners yesterday (February 11th) announcing the official launch of @Home in Raspberry Falls. What is important is that the letter contains your permanent registration authorization code and registration instructions to gain access to the private areas of the site.

Loudoun County property assessments were mailed last week. The
assessor indicates that the average property assessment is down 8%
from last year with the eastern part of the county down even more. The
west shows more modest decreases with some areas increasing slightly.
Kirby Bowers, the county Administrator, has proposed a 25.6 cent
increase in the tax rate to fund what he says is the most "lean" budget
in years. The proposed tax rate would be a 26.6% increase over the 96
cent 2007 rate. So lets do the math assuming your assessment is down 8%
on a $1,000,000 home in Raspberry Falls:
1997: $1,000,000 assessed value at 96 cents per $100 = $9,600 property tax bill.
1998: $920,000 assessed value at $1.216 per $100 = $11,190 property tax bill.
The result is equal to a 17% increase. But, if your assessment is like
mine which went up slightly, we are going to be paying a bit more than
the stated 26.6% increase due to the proposed tax rate.
So, I say watch your assessment. The last time I checked, Raspberry
homes sold in 2007 were selling for much less than what they sold for
in 2006.
The County Supervisors will no doubt pare the proposed budget by some amount but the result will still be a hefty increase.
The LCSA is proposing the management combination of multiple community infrastructures as opposed to stand alone as we now have in Raspberry. This means rates could change. LCSA held a meeting for homeowners at the RFG&HC clubhouse on February 20th.

A recent email from Scott Lutz to the Raspberry Falls community:
Raspberry Falls Resident -
As some in the community may know, there are two applications for three cell phone towers across from Raspberry Falls. I have attached my letter in response to these applications (the letter summarizes my comments I made at the Public Hearing on Tuesday, January 8th). At the Public Hearing the Board of Supervisors referred the applications to the Land Use Committee who met on Tuesday, January 29th. Instead of looking at any individual applications, the Land Use Committee took a step back and discussed whether the towers were needed and the wireless coverage areas across the County. The Committee asked for additional maps and coverage information across the County. I see this as a positive step. The Committee is going to meet again on this issue at the end of the month.
Recently, I was contacted by the Supervisor's Kurtz Office (our local Supervisor). Four of the six cell phone tower applications across the County are in the Catoctin District (more cell phone tower applications are coming through the pipeline). I was asked to reach out to our community to see what we thought of our wireless coverage.
As for me, I have a Treo for my personal phone/internet (Verizon) and I have a BlackBerry for my business phone/internet (Cingular). I never had a problem with either my Treo or BlackBerry within Raspberry Falls community or the Route 15 corridor.

From a letter dated January 3, 2008 to Raspberry Falls homeowners:
The Board of Directors for your association would like to add another homeowner Board member to the Board of Directors. Application for Candicancy must be returned to Armstrong Mangement by January 21, 2008.
The letter included the appropriate application form. Those interested should complete the application and return to Armstrong Management as soon as possible and before the deadline.
The letter also annonced that the Moorlands Homeowners Association (AKA Raspberry Falls HOA) meeting will be on March 13, 2008. This is being billed as the Annual Meeting and a further notice will be forthcoming.

In a letter to homeowners dated December 27, 2007 the HOA declares that the Board of Directors has not yet adopted the 2008 operating budget. Assessments remain the same for January and February of 2008. The delay is due to "research into community landscaping and other items and prefer to have answers to questions regarding these items" before establishing a new assessment level.

Loudoun County's newest winery, the Bluemont Vinyard, opened in October, 2007. Raspberry's own Bob and Loree Rupy are partners in the new venture. Located on the eastern slopes of the Blue Ridge Mountains, Bluemont Vinyard boasts an elevation of about 1,000 feet. Their unique theme is "where elevation not only defines our location, but also our goal."

The Leesburg Vintner recently launced The Vintner Blog announcing Saturday wine tastings and various wine specials. The Vintner has anchored the corner of Loudoun and King Streets in downtown Leesburg since 1988. Mike Carroll, the proprietor, has a knack for finding and stocking great wines at a value price. Mike and his crew routinely hold wine tastings each Saturday afternoon from noon to 4:00 pm featuring some of the newest offerings by his distributors. In addition to great value offerings, the Vintner also carries a selection of great vintages from around the world including California, France and Italy.
A new venture has just launched called Modern Mom. Initially focused on Loudoun County, Modern Mom includes a full featured social media web portal complete with "Blogs Du Jour" and a new quarterly magazine. Tennis Court Rules and Regulations
Noncompliance with the rules of the tennis courts may result in the suspension of recreational privileges. The tennis courts are for the exclusive use of Raspberry Falls Homeowners and Residents only. Please note that a member of the Association must accompany all guests.
Tennis Courts are to be used for tennis only, and no other activities.
No bicycles, roller skates, roller blades or skateboards, etc. are permitted on courts.
Tennis Courts are considered closed from dusk to dawn. Anyone on the courts during closed hours will be considered trespassing and can be prosecuted by the Association.
Children sixteen (16) years of age and younger not accompanied by an adult must relinquish a court to adults after 5:00 p.m. on all days.
Proper tennis attire required at all times (Shirt, Tennis Shoes, Pants/Skirt).
Playtime is limited to 90 minutes for singles play, 120 minutes for doubles play.
No more than four players to a court.
Keep the tennis courts clean, please take/remove all trash with you.
Food or glass containers are not allowed on the courts at any time.
No animals or pets are allowed on the courts.
Gates must be kept closed at all times.
Use of tennis courts must be conducted in a safe manner with due respect and consideration for others in the community. Tennis court rules and courtesies apply at all times. The use of profane or obscene language is not permitted. Rough play or abusive conduct is not permitted.
The Association is not responsible for lost or stolen personal property left in the recreational areas.
Association is not liable for any injuries sustained while utilizing the facility.
Pass code for tennis court entry is 2006.
These rules may be revised or additional rules established at anytime by the Raspberry Falls Homeowners Association.
Driving around Loudoun County provides an abundance of pleasant scenery: bucolic landscape, history, wildlife and the occasional "out of the box" sighting. This old barn and silo has been refurbished with a fresh coat of paint. It is an antique and home boutique store. I couldn't resist the picture. It is located just south of the village of Lucketts on Highway 15 (or a couple of miles north of Raspberry Falls). If you get close, you won't miss it.
A more recent drive-by revealed an old wagon stacked with various shades of pink pumpkins. Lets re-define the Halloween colors!
Early August, 2006 on a recent drive in western Loudoun County. The bucolic scenes are wonderful as you can see in this photo of a farm, rock walls and gravel/dirt roads. Looking west towards the Blue Ridge mountains the haze of a hot, humid day hang silently with nary a breeze to cool the skin. Stepping out from my air conditioned vehicle into this soupy air, my glasses instantly fog as does the lens on my camera. This is the kind of day we all wish for thunderstorms!

There are two distinct regions in Loudoun County: east and west. Eastern Loudoun features an urban lifestyle while the west is still characterized as rural. Western Loudoun is known for it's equestrian roots, farms and most recently, vineyards. Here is a sample of "horse country:"

This is the day many residents have been waiting for. Residents should have received a letter from Armstrong Management announcing the pool opening along with 2006 Pool Rules and Regulations, Hours of Operation and an application for membership. The Membership Application must be returned to Armstrong by May 1st. Armstrong will mail Pool Passes to residents prior to May 27th.

I haven't talked to anyone that isn't in assessment shock. Loudoun County mailed tax assessments to property owners last week and it seems there may be a storm gathering. According to the County Assessor half the county's residential property owners assessments rose more than 28%! That is after double digit increases the last three years. Even our Board of Supervisors are experiencing "shock and awe." The Leesburg Today reported these figures for our nine supervisors:

To keep the average tax bill from increasing, the board would have to lower the tax rate from $1.04 per $100 to $0.81, according to the news article. The County Administrator has proposed $0.97 with many new school and transportation projects.
There are reports of heavy phone traffic to the assessor's office. Surprised? Not me. Appeals may reach a record this year. It will be interesting to see if any of our board members appeal their assessments.
My overall assessment went up 20%. The land portion went up 41%!!!!!!! The good news is built up equity. The bad news is the computation of assessed value (it is supposed to reflect some percentage of market value).

All of us should have received the Notice of Public Hearing concerning the Proposed Zoning Changes Affecting Your Property issued on January 23, 2006. As most of us know, Loudoun County is embroiled in bitter disputes over the zoning, packing density in the east while keeping the western part of the county more open.
Raspberry Falls was zoned AR1 before and continues to be zoned AR1 in the proposed amendment. Besides that, the community was planned back in the early 90's and was theoretically "grandfathered" before being rezoned in 2003-2004 under the last Board of Supervisors. Although, rule changes significantly delayed the building of our community pool.
While these zoning amendments do not directly effect the residents of Raspberry, they will effect most of the undeveloped land along the 15 corridor. The good news is we won't have high density development adding to the traffic congestion on Route 15.

By law (the Virginia Property Owners Association Act) you must supply the potential purchaser a resale package for review when you ratify a purchase contract and prior to settlement. The resale package can be ordered via the internet at Armstrong's Resale Package Request Website.

Good news! A recent letter form Van Metre announced the county approval of the recreational facilities long on the drawing boards. The delay was caused by the implementation of the revised comprehensive plan in 2003 that ultimately put Raspberry Falls into a planning district restricting this type of facility. Long negotiations with county lawyers and some modifications to the plan resulted in final approval. Van Metre is predicting completion by the 4th of July, 2005.
As of this date, the county has not approved the final pool/tennis complex plans. Van Metre indicates all outstanding issues with the county have been addressed and they are waiting for the county to give final approval. Additional delays may jeopardize opening next spring/summer.

Merv Forney has official plans filed with the county that are under their review. These plans are subject to change due to county requirements. There are architectural plans available for viewing in the Marquis model. Again, subject to change.
7/31/2004: Van Metre to transfer all remaining home sales and construction to Marquis Custom Homes. New hamlets in the future are in the North-East portion of the property (East of Raspberry Plain near the 12th and 13th holes).

@Home Public Site Ready to Use

The @Home in Raspberry Falls public site is redesigned and in full production. An important feature of the public site is In The News, a repository of announcements, general news and information about the community, news from Van Metre, the county and the HOA.
The Residents Only portion that includes On The Vine and the The Directory is slated to be available on or about November 1st. Watch this space for a future announcement.
